Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your use of the Knitt headless CMS and hosting platform ("Service") provided by Knitt ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

Knitt provides a headless content management system (CMS) with integrated UK-based hosting. The Service includes content management, media hosting, REST API access, and optional add-on modules (Forms, Bookings, Automate).

3. Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use.

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law, regulation, or legal obligation
  • Host, store, or distribute illegal content, including but not limited to content that infringes intellectual property rights, contains child sexual abuse material, or promotes terrorism
  • Distribute malware, viruses, or any other harmful code
  • Send spam, unsolicited communications, or bulk messages
  • Engage in phishing, fraud, or deceptive practices
  • Attempt to gain unauthorised access to the Service, other accounts, or related systems
  • Interfere with or disrupt the Service, servers, or networks
  • Scrape, crawl, or harvest data from the Service except via our documented API
  • Use the Service to operate or support any activity related to illegal gambling, drug trafficking, weapons sales, or any other criminal enterprise
  • Resell or redistribute the Service without our written permission

We reserve the right to suspend or terminate your account immediately and without notice if we determine, in our sole discretion, that you have violated these acceptable use policies. No refund will be issued for accounts terminated due to policy violations.

5. Your Content

You retain ownership of all content you create, upload, or manage through the Service ("Your Content"). By using the Service, you grant us a limited licence to store, process, and serve Your Content solely to operate the Service.

You are solely responsible for Your Content and for ensuring it complies with all applicable laws. We do not monitor Your Content proactively, but we reserve the right to remove content that violates these Terms.

6. Hosting

The Service includes hosting on UK-based infrastructure. We will make reasonable efforts to maintain uptime and availability, but we do not guarantee uninterrupted service. We are not liable for any downtime, data loss, or service interruptions.

We do not provide any service level agreement (SLA) unless separately agreed in writing. Scheduled maintenance may occur with reasonable notice where practical.

7. Payment & Billing

Paid plans are billed monthly or annually in advance. Prices are in GBP (£) and exclude VAT where applicable. You authorise us to charge your payment method on a recurring basis.

You may upgrade, downgrade, or cancel your plan at any time. Downgrades and cancellations take effect at the end of the current billing period. No refunds are provided for partial billing periods.

8. Free Plan

The free Starter plan is provided as-is with no guarantees. We reserve the right to modify or discontinue the Starter plan at any time with reasonable notice.

9. API Usage

API access is subject to rate limits and usage quotas as defined by your plan. We reserve the right to throttle or suspend API access if usage exceeds your plan limits or negatively impacts the Service for other users.

10. Limitation of Liability

To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business, or goodwill, arising out of or in connection with your use of or inability to use the Service, regardless of the cause of action and even if we have been advised of the possibility of such damages.

Our total aggregate liability for any claim arising from or related to the Service shall not exceed the total amount you paid us in the twelve (12) months preceding the claim, or £100, whichever is greater.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under applicable law.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising out of or related to your use of the Service, Your Content, or your violation of these Terms.

12. Termination

Either party may terminate this agreement at any time. You may close your account through the platform. We may suspend or terminate your account for violation of these Terms or for any other reason with 30 days' notice, except where immediate termination is necessary (e.g., illegal activity, security threat).

Upon termination, we will delete your data within 30 days, unless retention is required by law. You are responsible for exporting your data before termination.

13. Changes to Terms

We may modify these Terms from time to time. We will provide reasonable notice of material changes. Continued use of the Service after changes constitutes acceptance. If you disagree with changes, you may close your account.

14. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
